Word is up here in NH that the Dartmouth College basketball team has been designated employees of the school by the NLRB, so it can now officially form a union. Dartmouth is contesting the ruling, but who knows where that will go. Gee, wonder if they'll opt to join the Teamsters - maybe go on strike for a piece of the gate, or ask for 4/5 year contracts instead of scholarships. Overtime games get them time and a half wages. Seriously, whatever the case this will be interesting to watch. www.espn.com/mens-college-basketball/story/_/id/39466589/nlrb-regional-official-clears-way-dartmouth-hoops-union

Absolute free for all…recruit (every player every year, pay them (which is not what NIL is )..it goes both ways if a player does not live up to expectations drop them and pay another player…more coaches will exit and oh wait the IRS and State Taxing authorities will want their share so I hope the players and their handlers are keep 25%-40% in a safe investment for taxes.

One wonders about the tax implications of NIL vs being an employee or NIL & being an employee. Also, I would think these figures from state universities would be publicly available.

The Collectives operate as entries that are independent of state universities, so they most like fall outside FOIA inquiries

If they become employees does that make their scholarship taxable income?

They are not university or college employees because they are not being paid by the university or college. They are being paid by NIL collectives. They will get 1099 from the collectives or whoever pays them. If the collective pays them and they have to do a Dunkin Donuts appearance, the collective gives them a 1099. If Dunkin pays them directly, Dunkin gives them a 1099.

So if they play a game in New York State …do they have to pay NY State taxes for that game?

So if they play a game in New York State …do they have to pay NY State taxes for that game? No, it's where the service is provided. Not playing the game, where the personal appearance or service is. Keeping w Dunkin Donuts, an appearance at a Boys and Girls Club on behalf of or sponsored by DD in Providence, RI tax. In Swansea, MA tax. But there are ways to simplify that by starting in RI. An Instagram post touting DD, potentially seen anywhere in the world, RI tax assuming it was posted in RI.
