Is this virus an “Act of God” or “Human initiated” action that could not be for seen or controlled by the party in the contract? The latter being Force Majeure.

I can't imagine that anyone at CBS or the NCAA would have foreseen the possibility that having bats on the menu in China would have resulted in this crisis.

Our Legal Beagle, 71 should weigh in on this one... I would expect that the Contract between CBS and the NCAA has some sort of "Force Majeure" clause that might render the Contract and associated payments moot (?) "Keep Calm, Wash Your Hands & Carry On" Pretty impressive for a non lawyer 82😳 Please do define Force Majeure for those who do not already know....

This was a standard clause in most every large deal I've negotiated through the years. The Force Majeure Clause effectively waives parties from their obligations on account of extraordinary circumstances outside their control. For instance, penalties & liquidated damages associated with the breach of contractual Service Levels would be waived if Data Center and associated Disaster Recovery Center sites outsourced to an IT company were interrupted on account of a natural disaster - such as an earthquake that impacted the regions of both Centers.

Looking more and more like our trip back East in May is not going to happen. Westerly is our hometown so when the wife sees this, I’m sure she will not want to go. At least I can still watch horse racing today.

A friend had tix to Tony Bennet (the singer) who was appearing at Foxwoods this weekend and the show was cancelled.
